Has anybody had problems with a background check for firearms. I won a pistol from the Arizona Elk Society and had it mailed to Sportsman's Warehouse in Flagstaff on April 7, 2019. I filled out the required background info and the CJIS placed it in "Delayed Status" which I'm still in today 2 months later. Sportsman's says there is nothing they can do and I have tried email and mail communication with the feds with no reply other than "If your status is delayed please be advised that the FBI is not accepting challenges for firearm-related delays at this time". Anybody on here know what if any avenues I have to follow up? I picked up a rifle about 3 years ago and passed the check with no problem so I just have no idea what to do. Thank You for any assistance or suggestions.

This happened to me about two years ago, so a hundred new laws might have come into effect since then. I had a gun transferred to Brunos, and I have a CCW permit which Sportmans accepts by the way and so does Healy Arms without the background check, but Brunos runs the check CCW or not. When the check was ran it was placed on hold. I ask why and I was told there was no reason given, so I ask what now and I was told that they had three days to call back and give a reason for the hold and if not I could pick it up. This was like on a Friday and Tuesday I got a call to pick it up. Like I said this was a couple of years ago and it sounds like you might need some legal advice and not from a Sierra Hotel Lawyer.

FFL only has to hold for 3 days if they don't get back to them they can let you pick it up but they don't have to. I would guess because they are a chain store maybe feel they can be held liable...IDK

I know a guy the same thing happened and after 3 days they didn't hear back from feds and gun shop called him to pick it up.

What he said. I got delayed a few years ago because I was going through my TSA pre check background check the same time I was buying a rifle from sportsman's in Mesa. I picked it up 3 days later.

I believe there should be a specific code for the cause of delay. I worked with a kid who used to do firearms compliance for Academy Sporting Goods. He helped another guy I know with an issue. I can reach out to him--

I would recommend calling their corporate office and request to speak with their compliance section.

Typically a delay gives them 3 business days to research your background. They are required to call back and deny you in that 3 day window, otherwise no call or response during that time means they can release the gun. 

Ask them to show there store policy if it differs from the federal law. 

Make them give you a refund or give you the gun.
