AZ bill to change public land ownership HB2210

My fellow public land advocates please take note of the new bill, HB2210, that just cropped up in our AZ state legislation -

AN ACT

directing the attorney general to commence an action to attempt to gain ownership or control of the public lands within this state.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Public lands; ownership and control; attorney general; analysis; litigation; delayed repeal

A. On or before September 17, 2018, the attorney general shall analyze at least the following legal theories that this state may pursue to attempt to gain ownership or control of the public lands within this state:

1. The equal sovereignty principle, which recognizes that for a federal republic such as the United States to function, each member of the republic must be equal in sovereign power.

2. The equal footing doctrine, which recognizes that each state must be admitted to the United States on an equal footing with the original thirteen states.

3. The compact theory, which recognizes that a compact was formed between this state and the federal government under which this state agreed to allow the federal government to retain land within its borders and the federal government agreed to promptly and completely dispose of that land by sale or grant.

4. The property clause, which recognizes that the framers of the United States Constitution intended to grant the power to regulate federal lands only in the context of disposal, not to permanently retain the majority of the land within a state.

B. On or before October 1, 2018, the attorney general shall submit a report of the attorney general's analysis pursuant to subsection A of this section to the president of the senate and the speaker of the house of representatives.

C. On or after November 1, 2018, and after consulting with the president of the senate and the speaker of the house of representatives, the attorney general may commence an action to attempt to gain ownership or control of the public lands within this state.

D. This section is repealed from and after September 30, 2026.

Hate legal mambo jumbo , I take it this is bad?

Essentially they want to take YOUR public lands that you have free accesws to since you and all the other citizens of this country own them and them make you pay an access fee to the State Land Department to hunt and fish on them.

Weninger one of the names who introduced the bill is the owner of the restaurant where I work. I got into a argument with him about it a few months back. In a nut shell the state is going to take public land and lease/sell it to make money. They could also make hunters pay a premium to have access to lands that are not leased or sold. This is very bad!!!

One of the guys Bowers, if that's Rusty Bowers which I'm sure it is, tried to close Rio Salado Sportsmans Club a few years ago. He owns land next to the range and tried to get it shut down, so some land developer could get his hands on it.

They have been trying to do that as far back as I can remember, decades and decades.

We already pay a fee for access to lands. Its called TAXES. This needs to get shut down.

And the darn Tonto Pass or parking "Day Use" fees at some of the lakes.

Amen to that. I pay plenty of access fees already.

 

I get tired of this crap every year. When are we ever going to have a ‘representative ‘ that actually cares about the people the got elected to represent. Whether you’re a hunter, hiker, mountain biker, or weekend car camper, these bills are bad news for ANY ONE that likes nature

Actually for state lands, it's your hunting and fishing license. No target practice, Questionable stand on camping. If it were managed properly, control would be closer to home but the state has a poorer track record compared to the feds, which have themselves been bad lately.

As a political independent I'll point out the obvious cuz you'all won't. Whether it is this situation or Utah or Nevada and everywhere else in the West this is happenning.
