How can you tresspass on "leased" public land? That's the problem, ranchers think that they own the public land that they lease for pennies.

maybe he shouldn't have used racist remarks... He played right into there hands...

They said he did, he said he didn't.

 

Plus, it's not against the law to be racist, it's only stupid.

 

The jury found the two men, Arturo and Ronald Morales of Douglas, partly responsible because they trespassed

 

Evidently, they were on his deeded land also.

 

They did not even get a ticket for trespassing, yet they end up almost $100,000 richer, for breaking the law.

Seems unfair any way you look at it. Sometimes you gotta just wish you were a "Jack Bauer" type. Shoot first, ask questions later.

There would be no need for courts and liberal judgements if everyone took care of things "old west" style.

The ones who get rich off cases like these are the lawyers and those with the best lawyers. Best Lawyer? What an Oxymoron.

Don't know about AZ but in NM in order for a trespassing count for stick the land has to be marketed every 50 yards and there can be no breaks in the fence.... It is usually pretty hard to get something to stick

I don't know the whole story if it was deeded land or leased land. But i do take my six year old daughter out with me on occasion and if someone is pointing a gun at her I am going to have definte problems with that a think a youngsters life rates over a peice of land.

Someone point it out if I'm wrong, but what I read was that they were on "leased grazing land" (2nd paragraph) which means it's public property that he has paid for the right to graze his cattle on. If some a-hole pointed a gun at me while I was on public land, he wouldn't need to hire a lawyer, he'd need a priest.

Yeah - count me in on the confusion also about tresspassing on leased grazing land. Just because he has grazing rights does not make it his land or anyone else trespassers - right???

Looks like Barnett needed special permission per the Az Hunt Regs.

A.R.S. 17-304

Prohibition by landowner upon hunting;

posting; exception

A. Landowners or lessees of private land who desire to prohibit

hunting, fishing or trapping on their lands without

their written permission shall post such lands closed to

hunting, fishing or trapping using notices or signboards.

B. State or federal lands including those under lease may

not be posted except by consent of the commission.

Please point a gun at me and my family while I'm on public land! Use racial slurs against me and my family while we have weapons and you better be prepared to use your weapon!

Sounds like he got sued for threatening the lives of the hunters and their children. I'd be suing his butt too if it was me and my family. It also sounds like he may have tried his forceful tactics on the wrong group of people this time?

 

Bottom line is they were granted the money in a court and by a jury of their peers, I don't know all the facts the jury does, but I'm assuming the rancher got what he deserved and it sounds like he had it coming for a while. I trust the court decision. I'm not saying that maybe he hasn't done good by stopping border-crossers, but there is a line and he was convicted of crossing it in this case.
