Trespassing

The cops wont do anything unless he is still on your property and wont leave. If he came and left he is not trespassing anymore so nobody will do anything to him legally. Even if you were there and happen to catch him you cant really do anything to him but ask him to leave.

Go down to the sheriff's office with that picture and tell them you want to press charges.

Talked to a cop friend and he said he couldn't look up the number. Against policy. He said the only thing to do is fence or if you catch the guy there again you physically have to tell him never to come back or he will be charged with trespassing as long as you have it posted.. A witness with you would be good too.

Arizona's laws on trespassing are different from many states, and I am most grateful for that. I'm not a lawyer, but as I understand it, a couple of signs on your road do not represent legal posting. Also, and I'm fuzzy about this, I think that you can only prosecute if you previously asked someone to leave, and you found him on your property again. I've hunted in states where trespassers were viewed to be lower than poachers, and wardens spent much of their time chasing and citing trespassers. I've also hunted in states where landowners were not required to post their land against entry, and hunters could lose their firearms and even vehicles for not knowing exactly where they were. I prefer Arizona's system and cringe whenever someone wants to tighten our trespass laws. I own land in Santa Cruz, Pima and Apache counties, and only thing I've posted is the driveway to my cabin. The sign does not say "keep out," it only lets people know my driveway is private property and not the popular forest service walking path that runs along the edge of our property. --- Bill Quimby

Exactly what my police friend told me. You have to tell them and then if they do it again they can be cited for trespassing.

that almost looks like round mtn in 10 -- all kinds of signs to make one think twice but a cable with a sign should work

Lots of signs like that in unit 10.....and across I-40 to the south as well.....raise the hair on your neck......

"Figure out who is the warden in your unit and call them forest service won't do crap"...............Nor should the AZGFD. I can think of dozens of more important things for wildlife managers to do. Why waste our money attempting to prosecute someone who merely drove past a "keep out" sign and left without committing any other crime? Arizona is not Texas. Trespassing here is not a serious crime. If I felt as you do, I'd have a sheriff's deputy stake out the driveway to our cabin and issue tickets to the dozen or more families with little kids who use it every day when they get off the forest service's walking path when returning from their "hike" to a pond above us. --- Bill Quimby

I've had someone turn off my camera before and found gatorade bottles that weren't mine but not that often

 

I mainly wanted to tell this individual he had no business on my property - once people find and start using my driveway - every tom dick and harry and some hunters come hunting season may think its ok to trespass-

 

I've had to petition the map software copy whom provides information to g&f habi map and others that the roads they have to my other land ,show it as a through road and its wrong - its ends at a top of a hill and no way across my land or my neighbors but it shows it on their maps

 

 

even though I have a huge sign at the bottom stating DEAD END private property - I get people coming up onto my land- if I leave the gate- marked private drive - open while we are there- here they come drving up to our trailer

 

if we are gone- gate locked - I always see tracts of someone turning around.

 

ticks me off to no end -- last I called - told still being reasearched

I have 40 acres in the White Mountains. From my own experience, if you do not live on your remote land, you have little chance of keeping the "locals" out. Posted signs mean nothing to them. They will disregard "no trespassing" and "private property" signs, hop your barbed wire fence, and continue to do whatever they did on your land before your fence went up. Sadly, "no hunting" signs in my area often result in cut fence wires, whereas the other signage does not. ...and you are right, cattle essentially have the right away on Arizona lands unless you put up a fence to keep them out. Sad to hear that people are affecting your spot. I have had a 5-gallon bucket and a $3 grill mesh stolen from my land, which is not much, but everything I have ever left over there. Good luck!
