Border Patrol Aid

I would like to see that! Could you imagine game and fish officer coming up to a group of agents and give the person a citation. Rumors will spread through border patrol "can't trust game and fish". This is like a police officer pulling over a fire truck going 5 mph over the speed limit on a non call. The agent that helped me was doing their job, we just walked by and the agent told us where they last spotted them. Looked at the screen less than a minute and pointed them out. Even with their location we still couldn't find them. Thanks for the help BP and as always if I see illegals I'll call it in. Most BP agents I in counter where real nice. The few Game and Fish officers I've encounter treat you like a criminal ( never been ticketed for anything if anybody was wondering). I also had a friend witness a potential poaching and called it in, in the warden was treating him like he was a poacher and demanded certain answers and demanded that he met with him. He just told him; well this conversation makes me not want to ever call in and help you guys out.

 

 

 

 

 

I suggested that the highest officials at AZGFD learn about this incident so they can investigate, identify and reprimand whomever threatened a federal agency or its employees, if that's what happened. The Border Patrol officer who passed along the info did nothing illegal or unethical, nor did the hunters.

R12-4-303

 

Unlawful Devices, Methods, and Ammunition

 

A. In addition to the prohibitions prescribed under A.R.S. §§ 17-301 and 17-309, the following devices, methods, and ammunition are unlawful for taking any wildlife in this state:

 

1. An individual shall not use any of the following to take wildlife:

 

a. Fully automatic firearms, including firearms capable of selective automatic fire; or

 

b. Tracer, armor-piercing, or full-jacketed ammuni- tion designed for military use.

 

An individual shall not use or possess any of the fol- lowing while taking wildlife:

 

Poisoned projectiles or projectiles that contain

 

explosives;

 

Pitfalls of greater than 5-gallon size, explosives,

 

poisons, or stupefying substances, except as permitted under A.R.S. § 17-239 or as allowed by a scientific collecting permit issued under A.R.S. § 17-238;

 

Any lure, attractant, or cover scent containing any cervid urine; or

 

Electronic night vision equipment, electronically enhanced light-gathering devices, thermal imag- ing devices or laser sights; except for devices such as laser range finders, scopes with self- illuminating reticles, and fiber optic sights with self-illuminating sights or pins that do not proj- ect a visible light onto an animal.

 

 

 

C.

Wildlife taken in violation of this Section is unlawfully taken.

This Section does not apply to any activity allowed under A.R.S. § 17-302, to an individual acting within the scope of their official duties as an employee of the state or United States, or as authorized by the Department.

So... According to Game and Fish regs, border patrol is exempt from this law.

 

Also the regs say, an "individual" may not use the following, does not say that an individual can not use information gleaned from another.

 

Sounds like G&F overstepping their bounds again.
