elkaholic Report post Posted September 18, 2014 There is no way in heck that this kid shoulda got a citation for a sparrow G&F - you aren't doing the youth program any good if you chit pick about a sparrow whom ever this G&F wildlife -worden -warden - cop - is there a quota you need to fill -?? teaching a lesson is one thing - but to go to the extent that you went to give this citation proves you really do not know how to deal with the youth hunters like he wanted to write a ticket and after he couldn't find anything else wrong . went out of this way to make sure this youth would remember not to shoot a sparrow especially when we all know the crap these wildlife managers seem to get away with! 1 Share this post Link to post Share on other sites

If he was in one of these closed areas, he did commit the offense. Sorry, and I hope I am wrong in my assumption of location. See the notes below. If he had just left it the officer wouldn't have even known that he had shot the stupid thing! The game and fish are crying about needing more hunters to pay for conservation but then do stupid crap like this to a kid who is just beginning to start his hunting career. It simply bolsters the argument that he didn't know it was illegal (innocence and ignorance are different). That being said, I of course agree with the majority here that a citation seems pretty harsh in this case. A little 'officer PR' and a discussion about rules & hunter responsibility would have gone much further and been much more effective IMO. Since he's a minor, hopefully the judge will see it that way. Also since he's a minor, hopefully it doesn't impact his record in the long-term (either way, I'm thinking this would not classify as a 'felony'...... I hope I'm right on that.). S. I am also not saying I have not mistakenly shot a bird that was not my intended game species. This will be a good lesson either way it turns out, to identify your target, and know when/where you can and can't hunt. I am also not bashing the officer. Most of them are hard working agents doing a job they love for little pay. Leniency by an officer is based on his/her discretion. I was not there, so I do not know the entire story or witnessed what occurred, so I will not speculate on how it all went down. I would sincerely doubt any judge would throw the book at anyone for a first offence of shooting a Sparrow in a technically closed area. We have determined that House Sparrow season is open year round for shotguns, statewide with a few closed areas specifically called out. We just need to determine WHERE this took place.
