My apartment complex wants to charge $$ for overnight guests. Is that legal?

The manager taped a new list of "Rules" to my door sometime yesterday and I was going over it today. All the usual stuff and it looks like it was more of a reminder to the tenants about things like no washing cars in the parking lot, where to park, no mechanical work yada, yada yada.

But they also include the following:

Overnight guests as limited to two (2) nights only. Additional nights will be assessed $10.00 per day, per person.

 

Heck, I'm one person in a two bedroom patio home in Mesa and while I realize the unit probably has a max occupancy of about 5 people and if someone moves in I have to added them to the lease I can imagine if a relative comes for a visit for a week or a long weekend that they can charge me more on top of my rent I already pay.

They want me to sign and date they new rules but I am going to pass until I can see if they can do this. Anyone care to share some comments about just the legality or where I can turn for some assistance from the City or maybe even the Attorney General?

Check your lease. I'd guess you'd want most over night guess to leave early the next day any way.

Normally if it is not in the original signed lease, it would not be legal. It is your home, and not a hotel. I think you could tell them to pound sand, and there would be nothing they could do, and you are under no obligation to sign an addendum to your lease if you don' want to. However, when your lease comes up for renewal, then there could be complications if you try to re-sign.

 

I was in the apartment maintenance business. I have seen first hand what property managers try and get away with.

Not sure what you'll find in the Arizona Tenants Bill of Rights but it might be a start. Also review your lease and see what 'terms' you may have agreed to unknowlingly when you signed the lease. Good luck...that would sure stink to get that on my door.

I would tell em they aint guest, them are kin folk.

And at the same time be lookin for a new place to call home.

Go tape a note on your manager's door stating that your monthly rent is going to be reduced by $300/mo, effective immediately. And ask him to sign and return it to you. And if he doesn't reply, tape another note on his door that states a late penalty of $250 is going to be assessed for not signing the first note. Sooner or later I'd imagine he will contact you, and when he does tell him you've unilaterally decided to change the terms of your lease, just like he tried to do.

Yep. I wouldn't think you have to sign crap unless you lease is up.
