ATF Confiscated a coworkers shotgun today

Apparently one of the guys I work with has somewhat of a checkered past. He has a felony, not sure what kind, on his record from about 25 years ago. At the time, he was sentenced to 3 years, suspended & the charge was supposed to be expunged from his record after 10 years if he was a good boy.

 

He never followed up on it to make sure it was expunged. ABout 6 months ago, he goes into a gun store out in Mesa some where & tries to buy a 12 gauge. Fills out all the paper work & it comes back as 'on hold'. 3 days later the gun store calls him & tells him everything is fine & he can come pick up the shotgun.

 

Fast forward 6 months to yesterday & he gets a phone call from an ATF agent asking if he did purchase the shotgun, so he says yes, he did. They arranged for him to bring it to work & meet him in the parking lot to verify the correct serial number. Well, they took it away from him. My boss & I watched it go down through the front office window.

 

I don't really know what to make of that. What the heck good is a background check if they just change their mind & come & take a gun you already paid for? It doesn't seem right that you can pass a check & then they can change their minds later, after the purchase.

 

Personally, if I was in the market for any firearms, I think I'd just buy used from now on.

Sounds like a lawyer may be needed if your co-worker wants his gun back. Bet your bottom dollar that big brother is watching all of us carefully.

That's what I told him. Call a criminal lawyer & at least get a consultation.

I had this happen 2-3 times when i sold guns. After the 3 day wait, a gun store could legally transfer the gun without a response from ATF. Only to have ATF call a few days later and say that the person was denied. It was crap, but then you give ATF all the guys info from the 4473 and they go and take the gun or clear up the BS.

Mixed feelings on this one.

 

#1, he should have made sure his record was cleared.

#2, the background check should have caught this before the transfer took place

 

The good news is, he wasn't hauled off to jail with yet another felony on his record. I'm all for law-abiding citizens owning guns, and some of the gray areas surrounding past felony convictions or often "trivial" restraining orders (mad x-girlfriend gets a restraining order just to pi$$ you off) can get muddy.

 

That said, I'd rather see the enforcement efforts going into the kind of follow-up that took place. He does have a felony record, and until *officially* expunged, he can't vote, can't own weapons etc.

Don't be surprised if he gets the 2 am wake up call to see if he has other weapons.

Yeah, it sucks that the ATF took his gun, BUT, he should have taken care of his past, AND he shouldn't have be able to purchase it in the first place. The system should have caught it before the ATF had to get involved.

 

I hope he'll be able to buy a shotty after he gets his record cleared up.
