In Need of Legal Advice.

I posted a month ago that my house was broken into , and all my rifles, guns, computers, cameras, etc... were stolen. :angry: The insurance today denied my claim, staiting that there was no visual damage to the house, thus not making it a burglary !!! :unsure: I sure could use some advice on any action I can take against the insurance that I have payed into for years. Now that I need their help, they do not want to help. What can I do? Anyone with experience in dealing with insurance company's? They have stolen alot more than physical property from us, my family and I are in need of help. Any ideas from the CWT family would be greatly apprecited. Thank You.

lesson for us all - break a window - any window ! cut screen on door - jimmy lock . they need physical evidence - what a joke - hope it gets figured out for you!

when my tv was stolen years ago ( luckily thats all they got) the police told me the same thing... it can not be classified as a burglary unless there was physical damage. i was lucky in my case my neighbor saw the moving truck at my house and we found out who done it.

when a co worker was basically car jacked at the gas station his insurance told him he was not covered because he left the keys in the ignition.

After you get this case settled, get a new insurance company.

Whoever said something has to be broken is very wrong. Below is the definition of a residential burglary according to Arizona law.

 

13-1507. Burglary in the second degree; classification

 

A. A person commits burglary in the second degree by entering or remaining unlawfully in or on a residential structure with the intent to commit any theft or any felony therein.

 

B. Burglary in the second degree is a class 3 felony.

I don't understand insurance companies. They make all kinds of promises to get your business, then when you need them, they are not interested in you. Hope this all works out well, keep us updated.

That stinks. I would definitely fight that one. Lot's of way's to get into a house without breaking anything. I would still consder burglery even if you left the front door open. They came in un-invited and took your stuff, what else are you going to call it?

"No visual damagate to the house" ??? So do they (isn. co.) expect the burglars to ran a truck into the wall to commit a crime? Does the ins. co. expect all burglars to break everything inside house and cause damage to the building?? Wow, the ins. co. are a bunch of retards. A noisy burglar is like some saying - hey I'm here, I'm stealing everything in this house come and get me! I can't believe it!!
