gbocardo Report post Posted December 24, 2011 Carlos, Sorry to hear about your situation. Calling a state insurance department is a good start. I'm in law enforcement and whoever told you to stage or create damage to make it look like someone broke in is wrong. You would be looking at insurance fraud and I guarantee if you got caught your situation would become worse. I don't know what your relationship is with your insurance agent but I have had the same agent for over twenty years and its normally their responsibility to fight for you in order to keep your business or its time to find a new insurance company. I was in a minor four wheeling accident and loose dirt caused my truck to slide sideways hitting a pine tree. Because of my oversize and wide tires there was no visible body damage to my truck but my gear box was bent to heck. The insurance adjuster tried to say because there was no visible damage they were not going to pay the claim. Needles to say I was pissed and told the adjuster to show me in my policy where it said their needed to be visible damage to constitute a car accident. I also called my Agent and gave him an ear full. He had a new adjuster review the claim and needles to say it was taken care of. In your situation I would call your agent and have him fight for you. Also have him show you in your policy where it says there has to be damage or signs of forced entry before they will pay the claim. Burglars are smart and in most cases will and can find a way in without leaving a trace. The definition you were provided about Burglary by MCelkhunter is exactly correct. Again, I would say contact your agent and have him show you your signed policy and have him/her show you their definition of a burglary and demand he fights for you. I will almost guarantee it will not say there has to be damage or signs of forced entry. If he does not fight for you, I would definitely say its time for a new company. I wish you luck and I pray the dirt bags who broke into your house get theirs......
cflores Report post Posted December 24, 2011 Update....Update !!!! Two great things happened yesterday. First is that they caught two people involved in the burglary at my house!!! Second after a couple weeks of battling with the insurance company, we have settled. It's not the amount I lossed, but its a start. PCSO you guys are awesome !!!Thank you my public safety brothers for getting two more POS's off the street. The insurance company is American Bankers. I was told by many people that the first person that you talk to is supposed to deny your claim, just to see if you will persue it. Well, I did and made things happen. They sent out an adjuster out who was incredible, he found the scratch by the lock that he called the "tool mark". "This is where they got in" he said. To help all the CWT family: First know what your limits on firearms is on your policy, if it doesnt cover it make some changes to it. Also, know all your limits to your policy are. Take pictures of everything you own, put it on a disc and put it away somewhere. Try and keep all your receipts with it as well. Also. a security system is great, but if they want in they will get in. The best according to many is video security, this way they can put a face to the POS's. Make it harder for them, the harder it is will make them look some place else for the easy score. Lastly, Thank You. All the support to me and my family, from offering advice to offering rifles for our hunts. You guys and gals are awesome !!! PS. We are looking for a .243 for my daughter and a .300WIN MAG for me. Thanks, and God Bless you all. Merry Christmas.

Snapshot Report post Posted December 24, 2011 Good to hear you at least are getting something. Insurance companies sure want our premium payments on time, but they sure don't want to pay anything out.

joeeden Report post Posted December 25, 2011 Gbocardo is absolutely right. I own an independent insurance agency and I am of the opinion that most of the ill feelings towards insurance companies are well deserved. The insurance company has signed a contract and a "promise to pay" just as we all do. If there is a viable loss that you have incurred, (like someone breaking into your home and stealing your property!) The insurer needs to step up and pay. It is very unfortunate that this is not always the case. In my humble opinion, your agent needs to be an advocate for you, not the insurance company. He needs to escalate to someone who will get the claim paid to your satisfaction. It was mentioned earlier, and it is very true, we are all expected to pay our premiums on time. Prompt payment should be reciprocated by your insurance company when you suffer a loss. Sorry to hear you had such a tough time.
