if anything its in the definiton of "road" being maintained for public convience- where if a speed limit is posted and you are driving slow may cause some kind of an accident!

 

 

Most of us can remember drivin down a rd during season - have g&f drive by and just wave or they will stop and check license - never in 40+ yrs of hunting az backroads has anyone ever mentioned driving slow was or could be concidered road hunting.

 

to the best of my knowledge --I've never seen anything in any published regulations for arizona that the term ROAD HUNTING was defined as illegal!

 

 

the only mention of roads and hunting in the latest regulations - has to do with hunting from a vechile ---

meaning taking wildlife from a vechile- which states -

 

"using a vechile to hunt while traveling on or off rd:and or chasing wildlife with a vechile, both are illegal"

No person may take wildlife from a motor

vehicle (including watercraft and aircraft),

except as permitted by Commission Order,

and under the provisions of the Challenged

Hunter Access Mobility Permit Commission

Rule (R12-4-217). “Take,” as defined by

law, includes pursuing, shooting, hunting

and killing wildlife. You are unlawfully using

a vehicle to take wildlife if you intentionally

drive around until you see the animal you

wish to harvest and then make an attempt to

take. “Road hunting” is illegal; so is pursuing

wildlife with a vehicle, chasing or heading off

moving wildlife with a vehicle, and driving offroad

to get closer to wildlife. You do not have

to shoot from the vehicle to be in violation.

 

Why is this so difficult for people to grasp? If you understand the definition of "road" and "take", you're good to go...

In several places (like Alberta) it is illegal to have a loaded gun while in transportation. IE, driving from one glassing spot to the next, your gun must be completely unloaded. If a warden stops your moving vehicle at any time and your gun is loaded, you're in violation.

 

 

Whether or not it would cure road hunting problems in Arizona I do not know. Whether or not it would be a good thing, I do not know. Some good points were made in favor of road hunting. It's not a personal choice I make, but then again I'm young and still have the ability to hike forever.

 

I'm assuming that this would divide a lot of hunters. But it's just something to think about.

yep - i stand corrected - they do define road hunting as illegal - guess i failed the guide test - lol

 

 

you can not look in either direction while driving down the rd - to and from any spot or camp - if animal is spotted do not stop or pursue - even if said game animal jumps in front of vechile - you are a road hunter - oh i forgot i didnt intend to see anything it just showed up!

I must admit I went road hunting once. It wasn't much of a challenge. Roads are everywhere. Problem is, what do you after you shoot one? :D

I never hike with 1 in the chamber and never drive with a rifle loaded but im always hunting! Glassing through the scope deserves a butt kicking though!

I believe the 2nd Amendment needs to be considered ! I carry a .45 1911 Colt in my vehicle – Loaded and chambered…. Now I would love to have a Game an Fish officer cite me for road hunting based on his “interpretation” of why I have a loaded firearm in my vehicle! This would be a civil rights violation! $Love to take that to court$$$$$$!

There used to be 2 closed hunts in Arizona – To prevent buddy hunting the AZGFD permitted only tag holders to have centerfire rifles/firearms in the field. This was found to be an infringement of the 2nd amendment…. The national forest is public domain and all civil rights are in effect on these public lands…. I was out calling predators during one of these closed hunts and I was using a shotgun shooting shot which was permitted as per the regulations then... A game warden happened by and checked our license’s and asked if I had any rifles in my truck, we had 2 rifles cased in the cab and he started to write the ticket for having rifles during a closed hunt… stating that he would be confiscating our weapons.... As he was writing I asked him if it was legal to shoot coyotes from the truck – He said no … Then I asked him where the “field” begins… He said that that was up to his interpretation…… He stopped writing the ticket and gave us back our licenses ….As a citizen it is my right to "Question Authority" ;) Some of the game officers let their "authority" go to their head especially the new ones!

What about quad hunters/riders riding around with their weapons mounted on the front of the quad – Easily accessible with the flip of the hold down strap…. How is this more acceptable than having a loaded weapon in the cab of your truck! "Road Hunting" is a subjective topic with many variables that could be "interpreted" this way or that....The quad patrol has defended their right to ride around with their bows and guns on several posts on this forum!

“Method of take” – Again we are defining “take” does this mean actually “harvesting” or intent to “kill” something…. I suppose the a$$ h0le that “takes” your game camera is actually “harvesting” electronic equipment…… :blink:

As for someone pointing a gun at me (not actually shooting) I would probably “interpret” this as a threat to my life…… Time to get busy defending your self ! If I had some jackwagon flinging lead in my direction with a deer rifle 200 yards away I would get busy with my weapon and there would be one less tag applicant in 2012! By the way KevinH you do have the right to defend your self! Did you have a weapon with you? Were you issued a man card? At the least I would have shot the tires off jackwagons Dodge Ram! <_<

Hey Jackwagon :blink: - This ain't Canada we have the 2nd amendment here....We made sure of that when we kicked all the king's men out of the Colonies... Quite a few of them tucked tail and headed for Canada. :D

You can't even have a pistol or assault rifle in Canada let alone have a loaded weapon in your vehicle! :lol:

Seriously? LOL you really need to read the regs better to understand. I have studied the regs for the guide test and let me tell you there is alot for people to learn if you just read. Just like stated in the post after yours you will see that it is illegal and to what point well that is up to the warden that stops you.

I have been guilty myself of doing this when I was younger. I have seen and jump out of the vehicle to shoot at a deer and was told as lonng as I am off the road and not shooting across it it was legal. But like I have said road hunting will be determind by the GF officer that pulls you over or gets you. But if nothing is wrong it will not stand up in court. Crazy huh? Just like a 2 trek "road" is it even a road since it is not a maintained for public travel?

Forgive me for still being a little confused, as i know some have been very clear as to the what the regs say. How is it possible to be legal while driving down any road (maintained) and shoot at any deer you see no matter what purpose you give for being in your vehicle. It seems to me that if you see a deer from your vehicle and decide to get out and of the road to shoot it, then you are road hunting. It seems i could be cited for road hunting while i am driving to another spot to hunt, if i shot a deer sited from the truck on the way. How would that not be road hunting if i used the vehicle in the process of harvesting the deer while driving to a new spot.
