azcoues Report post Posted July 16, 2009 I know this is not hunting related but i just received a ticket in the mail i was on indian school and 101 and for some reason scottsdale is posting 55 mph on 1 mile stratches instead of 65mph for no particular reason .I was going 66mph are they doing this to generate revenue for the city or what and i need your input on if this is disputable or what to me it seems unconstitutinal to do that for no particular reason any input would be appeciated thanks. When I recieved the "notice of violation" not "citation", all of the wording was put as "If you don't pay this, you "may" have additional costs, but license will not be suspended, no warrant issued, no points on driving record and so on. Just last week, I got a second notice in the mail stating that I had to pay the 181 dollar fine, show up to court before August 10th, or else I "may" have a warrant out for my arrest. Pretty wierd. What I don't like, its not a citation, just a notice that a person violates the speed limit. There are 1000's of people daily "violating" the speed limit, even in front of officers, given the flow of traffic, and they have no repurcussion. I don't like it one bit, but with the threat of a warrant, I guess I would rather pay the money. Can't afford to have a warrant. Good Luck. I would like to hear others' input too. bonecollector Report post Posted July 16, 2009 I had one a couple of years ago i ignored it twice then somebody came and left the notice on my front door they say I got "SERVED" since they left it at my front door. I ended up going to traffic school. I have a friend that works for DPS and he says its not a moving violation so it doesn't go against your driving record or your insurance. So whatever you do dont waste time going to traffic school and wasting your 1 time in 2 years traffic school class. Next time I will just pay the ticket its $30 more than class but I rather not sit through another 8 hour class. Share this post Link to post Share on other sites
Rio Report post Posted July 16, 2009 As I understand or have heard, since you were not served the notice/citation in person, it's not valid. They trying to guilt people into just paying the fine, but unless you are actually served it's not suppose to be valide. That's why if after you the notice you don't pay or show up in court, they send out folks to serve you, as long as you don't answer your door or talk to the person and let them serve you the citation, I've been told you are not liable for the fine. Switchback Report post Posted July 16, 2009 i also have a dps friend and he said don't pay....they will send reminders trying to scare you into paying but don't do it...then they will send someone to your house to serve you if you don't answer or if you do dont say you are the guy then they throw out the ticket and you are good to go... azhuntnut Report post Posted July 16, 2009 The process server must identify you by name, and then hand you the court summons. They cannot hand it to somebody less than 18. You have not been legally served if it is left on your door step. If somebody comes up to you outside of your home and you don't know them, do not speak to them at all. Most of the time they won't spend the extra money to send out a process server. Plus mail gets lost all of the time, and envelopes left on your doorstep could get blown away by the wind. Kilimanjaro Report post Posted July 16, 2009 I got one in PHX on I-10 at the big curve by Skyharbor in May.. I saw the flash go off and knew they had "caught" me... I got a "notice" in the mail.. Somehow, it got placed with the trash that goes into the shredder.. I say let them come to the house and serve me with a citation. Like that's gonna happen.. They've been pulled over several months later and the officers never mentioned them or said there was a warrant. So far I have won 3 traffice stop court cases and 3 are pending a court date. 3 are photo radar. The other day my niece answered the door and they served her she was 14. Well I threw it in the trash. I have had many photo radar tickets (30 plus) and never once have had to pay anything. If they serve you, you can trash it or on the back of the ticket, say it wasnt you and you cant identify the driver and send it in. Most times they will send it back in the mail and say this has been dimissed. I did have one time when they said it appeared to be me and they set a court date, I showed up and they said this is you in the pic and I said no its not and they said yes it is and I said Nope. If you do some research there is one judge named Keegan in the courts who views it this way and he has thrown out every ticket brought before him... maximus Report post Posted July 16, 2009 A friend of mine is a lawyer and he told me that 2 things to disregard are photo speeding tickets and jury duty summons unless you are served in person. i don't know if is good to take a chance but you can always say you haven't received anything.
