Private firearms sale question, please

Recommended Posts

Hi Everyone, Long time watching this group & not giving much back in return. I hope to start changing that today. I realize giving back and asking a question right off the bat is counter intuitive. My apologies. Anyway, I see a lot of firearm transfers happening here. My question is how do you best protect yourself from future possible problems after the sale? I understand that the buyer must be an AZ resident and not prohibited from possessing a firearm and be of legal age. Once it is out of your hands you do not know what the future could bring. How best do you cover yourself if something illegal does happen, especially if you are the original purchaser with FFL paperwork in your name.  I do not need the ATF knocking on my door! Asides from a bill of sale, do you require a CCW card or go to local gun store and actually do a FFL transfer or are there better options? I really do appreciate any responses from people that have done private firearm sales. Thanks, bruce

First off welcome to The forum and asking a question that's not asking where you should hunt when you suddenly drew a tag is super okay with everybody here I'm pretty sure.  I would simply require them to show you a driver's license and you write it down and complete a bill of sale print out two copies he keeps one or she and you keep one.

There was a post here a couple years ago where a member had sold a firearm to someone and that person ended up killing themselves with that firearm family didn't really go after the guy per se but it definitely made him feel like he had a cloud over his head from what I remember.

Just do your due diligence and make sure their ID matches them and they sign everything and that is your legal obligation as far as I understand it.

when I sell to private party, I get the ID, phone number and license plate number of the buyer when we meet.   I document the date/time and location of the sale.

I got a call from ATF one time.  They recovered a 1911 I sold and was asking questions since I was the original buyer.  I provided ATF with the info of the person I sold it to and they were happy I had that info.   I don’t know the circumstances around the firearm seizure.

Selling a firearm is legal period.

If you are really worried about it, just meet the person at a FFL that will do a nics check on them, you would need to pay the $30-$50 fee.

I confirm theyre a resident and not a prohibited possessor. I dont ask for much else usually since that is all that is required. I also dont buy from people if I know they take down my personal info. If my CCW isnt enough then I will pass. I have had the UofA police call me once because I sold a pistol to a young kid and he let his younger brother carry it around. THey just wanted to confirm I sold it to the brother. Luckily I remembered.

If it was me, I would use an FFL to transfer guns these days.  Too many people that can't pass a NICS check and try to buy private party.  I don't want to be at the end of an ATF trace with just a piece of paper or a phone number.

How do you do this?
