That's great news! I was curious how that would pan out and I gotta say I'm in 100% agreement. I hope other states start to follow this logical way of thinking.

Unfortunately, its only going to be valid in the states listed within the US 10th Circuit Court.  That case won't apply to us in the US 9th Circuit Court in Arizona and most of the rest of the western states.  I hope the 9th will see it and uphold it, but the two courts don't always talk to each other and work together.  I've learned this though having to work on projects in both Arizona and NM.  AZ is in the 9th Circuit and NM is in the 10th circuit.  The processes we have to follow for the same project (cross-state) are completely different because of the differing circuit court jurisdictions.

Wealthy landowners buy checkerboard parcels for a reason, basically 100% ownership for half the price. This would kill that. Fantastic and fingers crossed this spread nationwide.

I've worked with both 9th and 10th circuits for over 21+ years.  I know enough to know its a crap-shoot with both.
