Criminal damage is defined as A. A person commits criminal damage by recklessly : 1. Defacing or damaging property of another person; or 2. Tampering with property of another so as to substantially impair its function or value; or 3. Tampering with the property of a utility. 4. Parking any vehicle in such a manor as to deprive livestock of access to the only reasonably available water. B. Criminal damage is punished as follows: 1. Criminal damage is a class 4 felony if the person recklessly damages property of another in the amount of ten thousand dollars or more, or if the person recklessly causes impairment of the functioning of any utility. 2. Criminal damage is a class 5 felony if the person recklessly damages property of another in the amount of two thousand dollars or more but less than ten thousand dollars. 3 Criminal damage is a class 6 felony if the person recklessly damages property of another in the amount of more than two hundred and fifty dollars but less than two thousand dollars. 4. In all other cases criminal damage is a class 2 misdemeanor. This definition is from my old law book Arizona Criminal And Traffic Law Manual 1994-95 edition.

That law would be criminal damage, after going through the gate you could add unlawful entry or trespassing. I am finding out there are several stipulations and conditions for each situation. One needs to be careful with each gate. This is what I have found out at this point.

Well, it is "MAN" juice! I just couldn't hold it any longer. After all I was PISSED OFF. I did not hit the sign, however hind sight is 2020 Maybe I should have. LOL. I would have peed on the lock and chain . Maybe I should go out and practice more! Practice does make perfect!

TJ I e-mailed Amanda asking her to call me to talk about educating our fellow CWT'ers on the vast rules and regulations on the subject. I will post results as I get them. Thanks for your support

I received my second phone call from the state land dept. this morning. This call was from a MANAGER. She expressed concern over my posting here, moreover with the responses from some of you with regard to cutting and removing locks on gates. She wanted to advise removal of locks is against state law and that there is several parameters at play. There is AZGFD, ADOT,and ALD that all can lock access to state trust land at anytime for any reason. She also stated that when there is entities like EPNG and KM involved they are required by federal law to lock access to their roads to protect the infrastructure of the pipeline. She also stated that there could be access from another road and that I should research that possibility. She went on to say that access might be denied to vehicular traffic only and one could still walk in. I asked if that is the case then why don't they post signs to that effect. Her response was that there is to many roads and to much land to effectively post signs on all. She strongly encouraged me to post here what we talked about and to ask that you don't cut locks as others have suggested because there might be a legitimate reason as to why it is locked and you might get arrested in the process.She also stated that AZGFD is the lead Agency that looks into this type of complaint. She said she will request that the various rules and laws regarding trust land access be posted on their website. I in return asked that they post them on CWT.com, her response was they needed user access to the site, and she would be talking to Amanda on getting her to post them. I am eagerly awaiting the call from AZGFD on this matter and will post my findings.

At 7:16 am the state land dept. punted the ball into AZGFD's court. I will call the Tucson office when they open later.

I guess the good thing in this situation is I have some time before the Aug. hunt. i hope to have some answers tomorrow.

TJ that's right where I am at. I don't want to start cutting but, this area has good numbers of pigs and a few good mulies. I will give the authorities a try first. Have you delt with the big gas companies before?

Bill I must have missed your post! I am trying to go about this in the right direction. By posting this situation I hoped to gain some insight as to how others have handled a similar situation and who to report it to. If the AGFD is the agency in control then why don't the signs have their phone number on it? That is the confusing part to me.

One of the locks is actually on the gate, Kinder Morgan is the one with the chain. I just had to go, i didn't get the sign. Should I put a parental advisory on the post? lol

Yes I realize that is my pass, I just want to go about this with the law on my side. I can see El Paso Natural Gas and Kinder Morgan trying to push criminal damage charges for cutting the locks off. i don't need the hassle to interfere with the enjoyment of the outdoors and the thrill of the chase.

I even saw a mcso officer put a lock on one of the gates that said " state trust land" I honestly don't care who you are, if you can't abide by the laws of this great state you belong in jail. I don't want to resort to cutting locks off of posted gates that WE law abiding hunters have paid to gain access to, but if that is what it takes to get into the area I want to hunt in than that's what I will do!

What I have read is very informative but I don't see where the "POSITION" is stated. Does this post mean YVRGC is apposed to HB2072.
